An Introduction to the UK Data Protection Act and the EU GDPR

The General Data Protection Regulation will come into effect 25 May 2018. Therefore the GDPR will be in force before Brexit occurs regardless of the activation date of Article 50. UK companies will need to comply and have updated data protection protocols in place.

This half day course is designed to give a general overview and practical introduction to the UK data protection regime, covering key elements of the Data Protection Act 1998, Information Commissioner Office ("ICO") guidance, pertinent case law and the proposed changes to be introduced by the new General Data Protection Regulation ("GDPR"), predicted to apply to companies during the Summer of 2018.

It will provide you with a good overview of the legal regime with case studies and exercises so that delegates leave with a practical understanding of the key requirements of data protection law and guidance and where processes may need to be amended in order to be ready for the GDPR.

What is the course outcome?

A basic but practical understanding of the key requirements of data protection law both under the current regime and under the proposed new European law.

Specifically, the course will cover:

• The data protection principles;

• Data subject rights;

• ICO powers;

• The main changes to data protection law proposed by the new European General Data Protection Regulation, including:

o The Accountability Principle;

o The role of a Data Protection Officer;

o The global reach of the proposed law;

o Privacy Impact Assessments, the concepts of Privacy by Design and Privacy by Default;

o The increased threshold for consent;

o The right to erasure/to be forgotten

• An introduction to the rules on marketing

Who is the course leader?

The course will be delivered by Christopher Air, a solicitor based in the Technology, Media and Telecommunications practice at international law firm DAC Beachcroft LLP. He specialises in advising buyers and suppliers of IT systems, particularly within the healthcare sector, on a range of commercial issues.
